Terms of Service
These Terms govern your use of the Mzansi Bites website, mobile applications (when available), and delivery marketplace services operated by Mzansi Bites (Pty) Ltd in South Africa.
Last updated: 19 October 2026
1. Agreement to these Terms
By accessing mzansi-bites.co.za, our subdomains, mobile applications, or related services (together, the Platform), you agree to these Terms of Service (Terms). If you do not agree, do not use the Platform.
We may offer additional terms for restaurants, couriers, promotions, or Mzansi Bites+ membership. Those terms apply in addition to these Terms where relevant.
2. Who we are
The Platform is operated by Mzansi Bites (Pty) Ltd (Mzansi Bites, we, us, or our), a company incorporated in the Republic of South Africa.
For support and legal notices: support@mzansi-bites.co.za or +27 72 338 0369.
3. Marketplace role
Mzansi Bites provides an online marketplace that connects customers with independent restaurant partners and delivery partners (couriers). Unless we state otherwise, food is prepared and supplied by the restaurant you order from; delivery is performed by the courier assigned to your order.
We facilitate ordering, payment processing (where enabled), and communication. We are not the manufacturer of food items and we do not guarantee restaurant menus, ingredients, or preparation except as described on the Platform or required by applicable law.
4. Eligibility and accounts
You must be at least 18 years old to create an account or place orders. Couriers and restaurant partners must meet separate onboarding requirements (including valid identification such as a South African ID or passport where applicable).
You agree to provide accurate registration information and to keep your account credentials secure. You are responsible for activity under your account unless you notify us promptly of unauthorised use at support@mzansi-bites.co.za.
5. Orders, pricing, and payment
Menu items, availability, and prices are set by restaurant partners and may change without notice. Delivery fees, service fees, and promotions are shown at checkout before you confirm payment.
When you place an order, you make an offer to purchase from the relevant restaurant subject to acceptance (typically when the restaurant confirms the order on the Platform). Payment is processed through our authorised payment partners. Refunds and credits are handled according to our support policies and applicable consumer protection law, including the Consumer Protection Act 68 of 2008 where it applies.
Report missing or incorrect items within 24 hours via support@mzansi-bites.co.za.
6. Delivery areas and timing
Delivery is currently available in selected areas (including parts of Mpumalanga). Service areas and estimated times are shown in the app or at checkout and are estimates only — traffic, weather, restaurant prep time, and demand may affect actual delivery.
You must provide a safe, accurate delivery location and be available to receive the order or arrange contactless drop-off where offered. We may cancel orders if we cannot reach you or if delivery would be unsafe.
7. Acceptable use
You agree not to:
- Use the Platform for unlawful purposes or in violation of any applicable law;
- Harass couriers, restaurant staff, or Mzansi Bites personnel;
- Submit false orders, fraudulent chargebacks, or abusive reviews;
- Scrape, reverse engineer, or interfere with the Platform’s security or operation;
- Misuse promotions or referral programmes.
We may suspend or terminate access if we reasonably believe you have breached these Terms or harmed other users or partners.
8. Intellectual property
The Mzansi Bites name, logo, website design, software, and content we create are owned by or licensed to Mzansi Bites and protected by South African and international intellectual property laws. You may not copy or use our branding without written permission.
Restaurant names, menus, and images remain the property of their respective partners.
9. Privacy and personal information
We process personal information in accordance with the Protection of Personal Information Act 4 of 2013 (POPIA) and our Cookie Policy. By using the Platform, you acknowledge that we will collect and use personal information as needed to provide services, support, fraud prevention, and legal compliance.
To exercise POPIA rights (access, correction, deletion where applicable), contact support@mzansi-bites.co.za.
10. Disclaimers
The Platform and services are provided “as is” and “as available” to the fullest extent permitted by law. We do not warrant uninterrupted or error-free operation. Food quality, allergens, and dietary suitability are the responsibility of the restaurant; always check menu information and contact the restaurant or support if you have allergy concerns.
Nothing in these Terms excludes warranties or liabilities that cannot be excluded under the Consumer Protection Act or other mandatory South African law.
11. Limitation of liability
To the maximum extent permitted by law, Mzansi Bites and its directors, employees, and agents will not be liable for indirect, incidental, special, or consequential damages, or loss of profits, arising from your use of the Platform.
Our total liability to you for any claim relating to a specific order or event will not exceed the amount you paid to us for that order (excluding tips passed to couriers), except where a higher limit is required by law.
12. Indemnity
You agree to indemnify Mzansi Bites against claims, losses, and reasonable legal costs arising from your breach of these Terms, misuse of the Platform, or violation of third-party rights, except to the extent caused by our negligence or wilful misconduct.
13. Governing law and disputes
These Terms are governed by the laws of the Republic of South Africa. You consent to the jurisdiction of the South African courts, subject to any mandatory consumer rights to bring claims in your place of residence.
Before formal proceedings, please contact support@mzansi-bites.co.za so we can try to resolve the issue in good faith.
14. Changes to these Terms
We may update these Terms from time to time. The “Last updated” date at the top will change when we do. Material changes may be notified via the Platform or email where appropriate. Continued use after changes take effect constitutes acceptance of the updated Terms.
15. Electronic communications
You consent to receive communications electronically (email, in-app messages, or notices on the Platform) in accordance with the Electronic Communications and Transactions Act 25 of 2002. You may retain copies for your records.
